Public Offer

This document is an official offer (public offer) by the NGO "Foundation.101" to provide access to electronic training courses and educational materials on the courses.foundation101.org web platform.

1. General Provisions

1.1. Pursuant to Articles 633 and 641 of the Civil Code of Ukraine, this Offer is a public proposal by the Provider to grant any individual or legal entity (the Customer) access to educational materials and training courses under the terms set out below.

1.2. Full and unconditional acceptance of this Offer occurs when the Customer pays for the chosen access option for a training course, or registers on the platform to obtain free access.

2. Subject of the Offer

2.1. The Provider undertakes to grant the Customer access to the online materials of the selected training course (lecture notes, lectures, interactive presentations, self-assessment tests), and the Customer undertakes to accept and pay for (if the course is paid) the services provided under the terms of this Offer.

3. Course Purchase Options and Terms

The learning platform offers the following formats and options for obtaining access to courses:

🔑 3.1. One-Time Purchase (Lifetime Access)

Offer summary: The Customer makes a one-time payment of the course's set price and receives permanent (lifetime) access to all materials of that course.
What's included: Full access to all lectures, text materials, interactive presentations, self-assessment tests, and all future updates and additions to the course at no extra charge.
Refund terms: Funds may be refunded upon the Customer's request within 14 calendar days of the date of payment. Upon refund, the amount returned is reduced by the payment system's transaction processing fee, as well as an amount calculated in proportion to the number of days the Customer had access to the course materials (based on the daily rate applied to trial access).

🔄 3.2. Monthly Subscription

Offer summary: The Customer receives flexible access to the course materials with recurring (monthly) payment.
Features: A convenient option for those who plan to complete individual modules or assess the relevance of the materials before going through the full course.
Cancellation and refund terms: The Customer may cancel the subscription at any time via their personal account or the payment service (access remains available until the end of the paid period). Amounts paid for the current or past monthly subscription periods are non-refundable.

🎁 3.3. Trial Access (3 Days)

Offer summary: Temporary introductory access to the course materials for a period of 3 calendar days, at a special price or upon request.
Purpose: To review the structure, quality, and presentation format of the material before deciding to purchase full access.
Terms: The amount paid for trial access (if the trial is paid) is non-refundable.

🟢 3.4. Free Courses

Offer summary: Certain training courses or materials are provided with open access at no charge.
Terms: Access is provided free of charge and does not require entering any payment details.

4. Payment Procedure and Access Provision

4.1. The Customer pays for services by non-cash transfer through integrated payment systems, links to which are placed on the relevant course's page (/promo/<course_slug>/).

4.2. Access to the training materials is granted automatically, or within 24 hours after the payment system confirms successful payment or Cloudflare Access authorization.

5. Intellectual Property Rights and Content Protection

5.1. All training materials, including texts, presentations, graphics, tests, and code, are objects of intellectual property of the NGO "Foundation.101".

5.2. The Customer is granted a personal, non-exclusive right to view the materials for personal learning purposes. It is prohibited to copy, distribute, transfer access to third parties, publish, or use the materials for commercial purposes.

5.3. The platform employs technical content-protection measures (including personalized watermarks and copy protection). If unauthorized distribution of materials is discovered, the Provider reserves the right to block access without a refund.
